Terms of Service

1. Definitions

• Service: the informational and support communication service that Mes Yazılım provides to its own customers via WhatsApp.
• User: the customer who uses the Service and receives or sends messages.
• Content: any text, image, file, or information transmitted within the scope of the Service.

2. Scope of the Service

The Service is used only with Mes Yazılım's own customers, via communication channels previously consented to by customers, for the purposes of product/service information, customer support, and legal notifications. Advertising, marketing, campaign messages, and unsolicited bulk messages are not sent.

3. User Obligations

• Use the Service only for lawful purposes
• Refrain from sending content that infringes third-party rights, or that constitutes defamation, harassment, fraud, malware distribution, or similar content
• Refrain from any attempt to harm the operation of the Service or to gain unauthorized access to systems
• Provide accurate and up-to-date contact information

4. Message Reception and Opt-Out

By sending "STOP" or "DURDUR" in the relevant chat, the User may opt out of informational messages. Opt-out requests are processed immediately.

5. Third-Party Services

The Service runs on the WhatsApp Business Cloud API infrastructure provided by Meta Platforms Ireland Ltd. Meta's service rules and privacy terms apply separately: WhatsApp Business Policy, WhatsApp Business Terms. Mes Yazılım cannot be held responsible for disruptions, delays, or transmission errors arising from these third-party services.

6. Intellectual Property

All rights to the software, trademarks, logos, and content provided within the scope of the Service belong to Mes Yazılım or to the relevant third-party owner. The User may not copy, modify, or distribute this content without written permission.

7. Limitation of Liability

The Service is provided "as is". Mes Yazılım does not guarantee that the Service will be uninterrupted, error-free, or fit for any particular purpose. To the maximum extent permitted by applicable law, Mes Yazılım cannot be held liable for indirect damages, lost profits, or data loss.

8. Suspension and Termination of the Service

Mes Yazılım reserves the right to suspend or completely terminate the Service without prior notice to the User in case of use contrary to these Terms or applicable legislation.

9. Force Majeure

Mes Yazılım cannot be held responsible for failures of performance arising from causes beyond our reasonable control, such as natural disasters, epidemics, war, internet outages, or failures of third-party service providers.

10. Changes to the Terms

Mes Yazılım may update these Terms from time to time. The current version is always published on this page; the User may also be separately informed of significant changes.

11. Governing Law and Jurisdiction

The interpretation and application of these Terms shall be governed by the laws of the Republic of Türkiye. The courts and enforcement offices located at Mes Yazılım's registered office shall have jurisdiction over disputes.
